Trump’s Attempt to Ban Mail-In Voting Is Legally Impossible
During the 2024 election cycle, a significant but often overlooked development occurred: the Republican Party invested heavily—tens of millions of dollars—in revitalizing mail-in voting. This effort aimed to counteract the setbacks caused by former President Trump’s challenges to mail-in ballots in 2020. As a result, Republicans narrowed the mail-in voting gap with Democrats, and increased mail-in voting contributed notably to their recent victories.
However, Trump is now actively trying to undermine this progress by attacking the legitimacy of vote-by-mail. He has claimed, without basis, that he can eliminate mail-in ballots through an executive order. Experts and voting rights advocates emphasize that this is impossible under current laws. Rebecka Caruthers, CEO of Fair Elections, explained that the president does not possess the constitutional authority to unilaterally abolish mail-in voting, which is governed by individual states. Many states operate entirely or partially through mail-in ballots, and each state independently determines its voting procedures.
She added, “Trump cannot simply issue an order to stop mail-in voting, and many groups—including civil rights organizations—will challenge any such move in court.” The courts, including the Supreme Court, are tasked with interpreting constitutional boundaries and would likely find such executive overreach unlawful.
This latest attack appears to be a distraction tactic—an attempt by Trump to cling to the false narrative that the 2020 election was stolen via mail-in ballots. His claims about authorizing the end of mail-in voting through an executive order are baseless and legally impossible.
Despite Trump’s efforts, the American electoral system remains secure and legally protected. As confidence in him wanes nationally, it’s expected that voters will continue exercising their right, potentially ending his bid for the presidency in 2026. His attempts to interfere with mail-in voting are futile, and the right to vote via mail remains firmly in place.
