A father from Jacksonville was unaware he had become a father when he was wrongly jailed for two weeks due to a mix-up involving an identical name.
Samuel Vasquez, 29, was eagerly waiting for the arrival of his second child when, on September 12, he was detained and charged with assault. He was transferred to a facility in Polk County, over 200 miles away, to face accusations he did not commit.
Meanwhile, another man—Samuel Vazquez, 41, wanted for allegedly assaulting his ex-girlfriend and her dog—remained free during that time. The two men share only a nearly identical name; their ages, physical characteristics, and backgrounds differ significantly.
It was a one-letter difference in their last names that led to Samuel Vasquez’s wrongful arrest. His legal team, at Joshi Law Firm, proved his innocence after 13 days of incarceration. They showed authorities a mugshot of Vasquez, who lacked any criminal history, especially unlike Vazquez, who was on probation for prior offenses.
Additionally, security footage at the crime scene reportedly depicted Vazquez committing the assault, yet law enforcement in a different county was convinced they had the right individual based on text descriptions and reports.
Attorneys from Joshi Law Firm managed to clear Vasquez’s name by providing a photo to Vazquez’s ex-partner—who confirmed she had never seen Vasquez before—to establish his innocence. Consequently, all charges against him were dropped, and he was released. Meanwhile, Vazquez was detained and awaiting extradition to face charges in Polk County.
