A detailed 15-page memo argues Mamdani’s support for groups associated with anti-Israel and pro-Hamas sentiments could qualify as providing “aid and comfort” under the 14th Amendment, a clause historically used to disqualify Confederates after the Civil War.

The memo has gained support from two Republican representatives, Claudia Tenney and Marlin Stutzman, who believe Mamdani’s actions and associations violate his oath to uphold the principles of the U.S. Constitution. The group alleges that Mamdani has supported anti-Israel groups and called for non-cooperation with immigration enforcement agencies, which they contend could be seen as supporting hostile entities and ideologies like Marxism and Communism.

Supporters argue that Mamdani’s stance and actions disqualify him from elected office, referencing his oath when sworn in as a state lawmaker, which obligates him to defend the nation’s laws. Stutzman emphasized that Mamdani’s calls for socialist policies and opposition to federal law enforcement threaten New Yorkers’ safety and financial stability. They suggest that the use of the Disqualification Clause is justified in this case and call for Mamdani’s immediate removal from the ballot.

However, Mamdani has denied allegations of communism and maintains he identifies as a socialist. His campaign has not issued a comment regarding the memo. The move to disqualify him would require a two-thirds majority in both the House and Senate, and any decision could be challenged in court.

This effort appears to be part of a broader political strategy to challenge Mamdani’s rising support ahead of the upcoming election, with supporters viewing it as a matter of national security and adherence to constitutional standards.
