Born on a US military base in Germany to a US citizen father and a Kenyan mother, Jermaine Thomas was raised in the United States, primarily in Florida and Virginia. Despite his American upbringing, he now finds himself stateless after being forcibly deported to Jamaica, his father’s homeland, a country he has never visited before.
Thomas’ legal status was never questioned during his childhood. His family believed he was American because of his birth on a military base and his father’s citizenship. However, a 2015 court ruling stated that birth on a US military installation abroad does not qualify as birth within the United States for citizenship purposes. As a result, Thomas, now 39, was deemed ineligible for US citizenship, despite his extensive history of residence in the country.
His legal troubles in Texas — including convictions for theft, drug possession, and other crimes — led to multiple incarcerations. Following a probation violation in 2023, he was detained by immigration authorities. An encounter with ICE resulted in his being transferred to an immigration facility, and on May 28, he was deported on a flight to Jamaica, a country he had never visited.
Thomas described his experience as devastating. “All hope was lost,” he said, feeling like he had no future. His case highlights the complexities surrounding birthright citizenship laws and how individuals born abroad to US citizens can fall through legal gaps, especially when birthplaces aren’t considered US territory.
Living in Jamaica without citizenship, Thomas faces numerous hurdles. He’s currently homeless, unable to work or obtain legal identification. His family, fearful of their own potential deportation, struggles with helplessness as they monitor his situation from afar.
