Family Suffered Toxic Mold Exposure Due to Negligent Building Repairs
A family of four faced severe health issues after their Upper West Side apartment was contaminated with mold, allegedly due to neglectful management and improper repairs. The mother, a photographer, reported raising concerns about mold in January 2024, but maintenance ignored the warnings, allowing spores to spread further.
The mold infestation was discovered after a leak occurred, when workers replaced part of the wall and flooring without conducting proper testing. Subsequent inspections revealed widespread mold, including the presence of toxic spores like Stachybotrys. The family’s belongings, including furniture and belongings, were contaminated, with mold visible on walls, behind furniture, and throughout the apartment.
The family experienced a range of health problems. The parents and their two young children suffered from allergies, chest pains, vertigo, and fatigue. Most alarmingly, their 2-year-old son developed pustules and painful skin patches that caused him to scream in pain. Blood tests showed elevated levels of mycotoxins, such as satratoxin, indicating substantial exposure, and the mother believes the toxins could have been transmitted through breast milk to the infant.
The family’s efforts to address the issue included calling in independent inspectors and conducting their own testing, which confirmed unsafe levels of mold. Despite assurances from the building’s mold assessor that the problem was resolved, remediation was inadequate, and the mold reappeared, worsening their health and living conditions.
The situation prompted the family to leave the apartment in May and return to the UK. Their lawyer emphasized that the repeated reoccurrence of mold indicates negligent management and failure to address the initial leak properly. Their case highlights concerns over the building’s maintenance practices and the health hazards posed by unresolved mold issues in residential buildings.
Such environmental neglect has resulted in serious health consequences for the Donnelly family, with the family now seeking justice for their exposure and suffering.
