Former In-N-Out Employee Files Discrimination Lawsuit Over Natural Hair Termination
An ex-employee of the popular fast-food chain has filed a lawsuit alleging racial discrimination related to his natural hair. Elijah Obeng, a California native, claims he was unfairly treated and dismissed from his position because of his hairstyle.
The legal complaint asserts that Obeng, who worked at In-N-Out from his high school graduation in 2020 until his termination in 2024, followed the company’s grooming policies while maintaining his natural hair. The company’s policy required employees to be clean-shaven and keep their hair tucked under a hat.
Despite adhering to these standards, Obeng says he faced increased scrutiny, harsh discipline, and was denied promotions, unlike his colleagues. As his hair grew longer, management told him to either cut it or modify it, which he attempted by braiding. However, he claims he was then ordered to shave his sideburns and was publicly humiliated when disciplinary action was taken in front of other staff.
Obeng states he was reprimanded for minor infractions and was not given equal opportunities for advancement. He was eventually sent home to shave his sideburns, which he describes as humiliating and discriminatory. Shortly after, he was fired, with the company citing previous write-ups. Obeng counters that his dismissal was rooted in his race and natural hairstyle, violating his rights under anti-discrimination laws.
He is seeking $3 million in damages and $200,000 for lost earnings during and after his employment.
Obeng’s legal team alleges that In-N-Out violated the CROWN Act, legislation designed to prevent race-based hair discrimination, which is enacted in 27 states, including California.
The company declined to comment on the ongoing litigation, stating they do not comment on legal matters. Obeng and his attorney have yet to respond publicly to inquiries.
