Legal Dispute Threatens Bryant Park Grill’s Future

The operator of the historic Bryant Park Grill, Michael Weinstein, has filed a lawsuit accusing the nonprofit organization managing the park of age discrimination, claiming he was ousted in favor of celebrity chef Jean-Georges Vongerichten due to his age.

Weinstein, 81 years old, leased the restaurant—renowned for its glass-enclosed design—for three decades through Ark Restaurants, generating around $25 million annually. The lease expired in April, and the Bryant Park Corporation, led by Daniel Biederman, chose not to renew it, instead selecting a partnership involving Vongerichten’s Seaport Entertainment Group.

Weinstein’s legal team alleges that age bias played a role from the start of the lease renewal process. In court documents, Ark’s lawyer, Anthony Genovesi, stated, “Biederman used Mr. Weinstein’s age against him from the beginning,” claiming the organization’s actions constitute discrimination. Biederman countered, insisting age was not a factor and highlighting that the lease was for 18 years, with questions posed to all applicants about continuity if faced with unforeseen circumstances.

Weinstein also challenged the fairness of the bidding process, asserting it was improperly conducted and filled with defects. A judge previously dismissed Ark’s request for an injunction to halt his removal, citing dissatisfaction alone does not imply bad faith.

Meanwhile, Weinstein continues to operate the restaurant and an outdoor café despite the lease’s formal expiration, leading Biederman’s legal counsel to suggest eviction could happen soon, though the process might take several months.

As these proceedings unfold, Weinstein remains in place through the busy summer months, with plans for potential closure and extensive renovation once Vongerichten’s team gains control, a process expected to take up to a year.
