The White House has clarified that Neera Tanden, a former senior adviser to President Joe Biden, is not protected by executive privilege and must testify openly about Biden’s mental acuity. This decision was confirmed prior to her scheduled appearance before the House Oversight Committee for a closed-door interview to assist in their investigation into Biden’s cognitive health and the administration’s use of the auto-pen signature system.

While executive privilege generally allows presidents to keep certain communications confidential, it was invoked by Trump administration officials during congressional inquiries, notably by members of his team. However, in this case, the White House indicated that the congressional need for information outweighs confidentiality concerns. The deputy White House counsel stated, “This presents an exceptional situation in which congressional access is justified.”

Tanden, who served as a senior adviser until 2023 and was nominated to lead the Office of Management and Budget, expressed her willingness to cooperate. She remarked, “I answered every question and a thorough process it was.” When asked if there was an effort within the White House to hide Biden’s cognitive decline, she responded, “Absolutely not.”

During her interview, Tanden noted limited interaction with President Biden and admitted she was unaware of how decisions requiring his approval via auto-pen were vetted — despite disseminating related memos. She also said she hadn’t discussed Biden’s health or mental fitness with administration officials since 2023.

The investigation into Biden’s mental fitness, led by the Oversight Committee, seeks to verify the legitimacy of executive actions and examine internal processes. Upcoming testimonies include testimonies from aides like Anthony Bernal, a former chief of staff to First Lady Jill Biden, who will speak on Thursday.

Biden has publicly dismissed concerns regarding his mental health, asserting that he personally made critical decisions, including pardons and legislative acts, and counters claims of cognitive decline. Additionally, former White House physician Dr. Kevin O’Connor is scheduled to testify on July 9.

Meanwhile, investigations into Biden’s use of the auto-pen signature system continue, with the Trump administration initiating related inquiries, including one directed by former Attorney General Pam Bondi.
