Long Island Frees Guatemalan Student After THC Gummy Incident

A Guatemalan man was released without bail after being accused of selling THC-infused gummies that hospitalized 12 middle-school students in March. Wilmer Castillo Garcia, 22, faces charges of endangering a minor and other related crimes, including selling cocaine and marijuana to an undercover officer on two separate occasions. He pleaded not guilty.

The students fell ill after consuming gummies containing THC, the psychoactive compound in cannabis. Investigators traced the candies to an Instagram account, linking them to Castillo Garcia. The packaging resembled popular snack brands, which raised concerns about underage access.

Defense attorney Matthew Tuohy stated that his client has had a difficult upbringing and is now receiving family support. Despite facing four felonies and two misdemeanors, a judge ordered his release on his own recognizance, citing the non-bail-eligible status of the charges under New York law.

Prosecutors criticized the bail laws, noting the difficulty in securing justice given Castillo Garcia’s status as a foreign national with potential means to flee the jurisdiction. However, Tuohy argued that Castillo Garcia is not a flight risk, having attended court voluntarily and hiring legal representation.

The case will continue with a scheduled court appearance set for September 2. If convicted on the most serious charge, Castillo Garcia could face up to nine years in prison.
